Traveling home this arvo, the road is a 2 lane two way road except at a
set of traffic lights. For a couple of hundred metres each side a left
land is added making a 4 lane dual highway. The lights go red, in front
is a high top van which pulls into the left lane and a car in front of
me in the right lane as am I. The lights go green, but at that moment an
ambulance arrives lights flashing and siren going behind me.

All that has to happen is for the van to stay where he is, the car in
front to pull forward and into the left lane with room for me to follow.

What happens is that the van does the right thing and stays where he is,
but the car in front just sits there transfixed. I'm boxed in with
nowhere to go. Eventually, with some encouragement, he does move forward
and over, and I can get out of the way. What a bloody idiot, even
without the ambulance, he had a green light but he just sat there.

from and wanted to be sure before he moved off?

Dunno. I wasn't there. But some people are spatially defunct.

Pretty sure I know exactly where Keith was, its near my friends house
and there is a new ambulance station not far away.
Ambulances with lights and sirens on are pretty common on that bit of
road mainly due to there being a lot of older people living in that
general area who are prone to medical emergencies so if the driver in
question was a local they should have been used to ambulances.

Even if he was deaf, he had a green light, he could have moved off. Not
hard to work out where it was coming from though, the ambulance was on
my back bumper siren blasting, and its flashing lights must have been
visible in his rear view mirror over the top of my car.

Maybe, but it's a fatal error to assume everyone's as clued in as you
are. Some people are really, really stupid.

Look at Felix, for example....

I think it was about the 1980's that we started to see ppl who
intervened to assist a victim have legal action taken against them, or
be charged with a crime, which caused ppl to think twice about being a
'good Samaritan'. nowadays it's even worse. many ppl, especially young
ppl, don't even think about helping. they just pull out their mobile,
and start filming. there's been occasions, as I recall, where ppl have
been attacked on buses or trains, and no one has helped. fortunately
tho, there are still ppl who do help. I wish we had the situation here
in Oz that exists in America where you can use lethal force if you fear
for your life, or your home is invaded. ppl should not have to think
twice about what they're legally allowed to do to defend themselves,
their family, or their property. it's just wrong!

The law in Australia clear enough - you can use lethal force to protect
yourself, or someone else, from death or serious bodily injury.
Generally speaking, the rule is that your action must be a reasonable
response to the situation as you see it. This latter point ensures that
killing someone who's pointing a gun at you is OK, even if it turns out
the gun was fake, or wasn't loaded.

Since it falls within a state jurisdiction, the exact wording of the
defence varies.

I don't know the origin of this idea that one is not allowed to protect
oneself in Australia.

It's an invention of people looking for something to complain about for
the sake of it. Like Felix is doing above for example. You have *always*
had a legal right to defend yourself in this country as far as I'm
aware, and the limit of reasonable response as you've described is how
it's always been.

What Felix seems to be complaining about is that blowing someone's head
off with a shotgun because they walked onto your property and rang your
doorbell without permission isn't considered a reasonable response.

He's a wannabee American.

that problem is the proviso that your action must be reasonable. if you
kill someone, and the Police or courts determine that your action was
not reasonable, then you're in trouble. the advantage of the American
model is that you have cart blanche to defend yourself.

to do to defend themselves, their family, or their property. it's
just wrong!

Have a nice day!..
The law in Australia clear enough - you can use lethal force to
protect yourself, or someone else, from death or serious bodily
injury. Generally speaking, the rule is that your action must be a
reasonable response to the situation as you see it. This latter point
ensures that killing someone who's pointing a gun at you is OK, even
if it turns out the gun was fake, or wasn't loaded.
Since it falls within a state jurisdiction, the exact wording of the
defence varies.
I don't know the origin of this idea that one is not allowed to
protect oneself in Australia.
that problem is the proviso that your action must be reasonable. if you
kill someone, and the Police or courts determine that your action was
not reasonable, then you're in trouble. the advantage of the American
model is that you have cart blanche to defend yourself.

We don't see many cases before the courts, which probably means that
whether something is reasonable is pretty clear to all concerned.

Some people believe that "reasonable" means something akin to
"proportionate" (can't use a gun to defend against a knife, for
example), but it doesn't.

I am bothered that the law takes no account of the fact that the person
doing the defending was usually not on notice that they were going to be
attacked, and that their thinking will have been clouded by an
adrenaline rush that was not of their own making. It is too easy for the
prosecution and courts to second guess such people from the comfort and
safety of their respective armchairs.

For some inexplicable reason some people just freeze up when there is
some sort of emergency, their brain doesn't seem to understand that they
need to do something.
They're afraid of the lawyers, and the intrusive media.
I think it was about the 1980's that we started to see ppl who
intervened to assist a victim have legal action taken against them,
or be charged with a crime, which caused ppl to think twice about
being a 'good Samaritan'. nowadays it's even worse. many ppl,
especially young ppl, don't even think about helping. they just pull
out their mobile, and start filming. there's been occasions, as I
recall, where ppl have been attacked on buses or trains, and no one
has helped. fortunately tho, there are still ppl who do help. I wish
we had the situation here in Oz that exists in America where you can
use lethal force if you fear for your life, or your home is invaded.

Its much more likely that the reason we don't see very
many before the courts is because the victim usually ends
up dead, particularly in domestic violence situations.

I'm sorry Keith. I keep forgetting you're so superior to other people,
and don't want to be bothered by inferior humans. it must be a bad day
for me, because I'm also failing to remember, that even though this is
an unmoderated public forum, and anyone can post whatever they wish, in
any manner they wish, nevertheless you have total control over it, and
can dictate what others must do, as you have been so well taught by your
mentor noddy.

In fact it's old English dating back to the 15th century at least.

How many times do you have to be told, do not cross-post from
here. If you really must put it in another group, copy it across
and start a similar thread there. There are enough loonies here
without dragging them in from places like aus.legal.
Get off your high horse you fucking pillock.
exactly. what a pretentious twat he is.
Bet you wouldn't recognise a twat if you saw one.
I recognized you
I don't think you know the meaning of the word.
I do. but you don't obviously. which is surprising since it's British
in origin
twat
/twat,twÉ’t/
noun
vulgar slang
noun: twat; plural noun: twats
     1.
     British
     a stupid or obnoxious person.
     2.
     a woman's genitals.
In fact it's old English dating back to the 15th century at least.
Personally, I don't see it as an insult as, over the years, I've had a
great deal of pleasure from such things. Your mileage may vary.
You've had great pleasure from being stupid and called a twat? Ok,
whatever floats your boat I guess.

obviously he's referring to definition 2. so now he's boasting about his
sexual exploits, along with the other stuff, ie. working for NASA,
software development, etc., but since he's been married to the same
woman for 50 years (allegedly) if there's been other than conjugal
activity, he's been a very naughty boy!

Sometimes I'm faced the situation where I can hear the sirens, but are
unable to tell which direction they're coming from, which can make it
difficult to know what action to take. The sirens themselves don't help
- a constantly varying pitch messes up part of the hearing mechanism
that allows one to discern the direction.

So, people may not be freezing, just trying to figure out what they
should do.

The siren was one car length behind the idiot, if you can't work out the
direction at that distance, you are basically a menace on the road.

Absolutely, some people shouldn't be driving.
